Order For Sale

An Order for Sale is an Order by the Court that the property subject to the Charging Order is to be sold in order to repay the debts due to all creditors. The Court may place a minimum price over the property for it to be sold and can only be granted by the Court if they are satisfied that the debtor (customer) has not made any realistic steps to repay the debt owed under the County Court Judgment. An Order for Sale is the last stage of enforcement and should only be used in rare and determined circumstances as the debtor and his/her family may be evicted from the home.
